Activist Judge Blocks Alabama Abortion Law, Playing Right Into Pro-Life Hands

Alabama Republicans are hoping to take a new Alabama abortion law all the way to the Supreme Court in hopes of overruling Roe v. Wade.

Two and a half weeks prior to a new Alabama abortion law banning abortion at any stage was set to take effect on November 15, a federal judge issued an injunction Tuesday declaring the bill “unconstitutional." The injunction, though, does not come as a surprise to either side as the bill was designed to be appealed up to the Supreme Court where it would provide a constitutional challenge to Roe v. Wade.

It simply criminalizes abortion. Hopefully, it takes it all the way to the Supreme Court to overturn Roe v. Wade, - bill co-sponsor Teri Collins (R-Decatur).

The proposed abortion bill would make abortion at any stage of pregnancy illegal and performing one a Class A felony, punishable by up to 99 years in prison. Women who received an abortion, however, would not be held criminally culpable or civilly liable.

Introduced in April, Alabama’s abortion bill would only allow abortions in cases in which “a serious health risk to the unborn child’s mother” is posed. Out of the 105-member Alabama House of Representatives, 60 members were co-sponsors of the bill.

Life Site News reports that Alabama Attorney General Steve Marshall intends to take the bill before the Supreme Court, and one of the Bill's co-sponsors, State Representative Teri Collins (R), has stated he believes that battle would be successful: "I remain confident that our mission will be successful and appreciate the support of millions of citizens who support our effort to preserve unborn life."

Roe v. Wade's Destructive and Unconstitutional Legacy

The overwhelming majority of scientific research backs the assertion that life begins at conception, meaning Roe v. Wade has enabled the deaths of at least 60 million babies to date.

As widely acclaimed public policy think tank Just Facts notes, "the four defining characteristics of life are present during or just after fertilization." These four characteristics are growth, reproduction, metabolism, and response to stimuli. Additionally, genetic and biological studies have shown that a fertilized egg has genetically distinct DNA from either parents. This meansthat, from the moment of fertilization, a baby is its own living organism that is distinct from either parent.

Constitutionally, the right to liberty, common defense, and justice is guaranteed to the unborn via the Preamble, which states the Constitution applies to "ourselves and our posterity." Further, the U.S. Code was amended in 2004 via the Unborn Victims of Violence Act to assert a child in the womb is alive and anyone who kills the child has committed murder.

Pro-Life advocates are hopeful of Roe v. Wade's reversal. And Gallup's polling has found that almost half of all American males and the majority of females are Pro-Life. Further, a poll by Pro-Life group Students for Life of America has found that 65% of Millennials are in favor of abortion legislature.
